Melior files criminal complaint with the Dallas FBI
Dallas, Texas, August 15, 2005 --- With the conclusion of an extensive preliminary investigation and evidence collection, Melior, Inc. files a criminal complaint with the Dallas FBI office.
Having been victimized by an extensive patent and software fraud in Germany, Melior concluded the preliminary investigation and evidence collection, and submitted a criminal complaint to the Dallas FBI office today, for further investigation and presentation to the US Attorney's office for criminal prosecution.
"Being a U.S. company, the first step for the company is naturally to seek the assistance of US government agencies to further investigate, and initiate the necessary steps to prosecute successfully," states Mr. Thomas J. Ackermann, CEO of Melior, Inc. "While the funds we lost through this fraud are certainly very painful for any start-up company, and a harsh set-back towards our own efforts to bring critical, new security technologies to market quickly, we realize others have been victimized to a greater extent as Melior, Inc. - we, however, are committed to continue product development, despite this loss. With 300 million Internet users successfully protected against Denial-of-Service attacks launched by the Russian Mafia, and having done so with alpha and beta code product versions, and subsequently receiving encouraging reviews throughout the development cycle, we cannot accept this fraud as a fatal setback - no matter the circumstances."
"While the other victims are mostly German tax payers, as the fraud cost the German IRS and the German Social Security Agency in excess of a combined 1 million Euros, we feel an obligation to commit precious ressources towards the prosecution effort to file the charges, beyond the recovery of our own funds", he continues. "Realizing throughout the investigation phase, that not only individuals, but also other parts of the German government, as well as several small- and medium-size businesses and a large German bank contributed to the fraud actively or at least through gross negligence, has certainly been a surprise."
"Finding out the entire Linux community has been affected by GNU-License violations as well, adds to our determination; as Melior has been a strong supporter of Linux technology and open access software, most notably by contributions to the Gentoo Linux version, for which we donated server machines and extensive bandwidth for the global application development platform."
Mr. Ackermann goes on to say, "we are confident towards a resolution serving justice, and to recover our own lost funds through the criminal trials in Germany, and subsequent civil trials with the additional option of punitive damages in the United States. We respect the German laws, which prevent Melior, Inc. from naming the perpetrators until a criminal prosecution becomes public record in Germany, and will aid both the US and German prosecution to the extent of our capabilities. Under the circumstances, we were lucky to having been able to collect all relevant evidence to help prove the case for all the victims involved."
